1. Agreement to Terms
By accessing and using Publish Hub Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not use the Service. We reserve the right to modify these Terms at any time, and changes become effective immediately upon posting to the Service.
Your use of the Service is also governed by our Privacy Policy, available at publishhub.pro/privacy.php, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully before using the Service.
2. Service Description
Publish Hub Pro is a multi-platform content scheduling tool that enables users to:
- Connect and authenticate social media accounts via OAuth
- Schedule and manage video and content publishing
- Automate content delivery across supported platforms including TikTok, Facebook, Instagram, and others
- Track posting history and publishing status
3. User Eligibility
You represent and warrant that:
- You are at least 18 years of age or the legal age of majority in your jurisdiction
- You have authority to bind yourself or the entity you represent to these Terms
- All information you provide during registration is accurate and lawful
- You own or have permission to manage the social media accounts you connect to this Service
4. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Notify us immediately of any unauthorized access or security breach
- Use the Service only for lawful purposes in compliance with all applicable laws
- Not allow unauthorized persons to access your account
- Log out of your account when using shared devices
5. OAuth Authentication & Data Authorization
By connecting a social media account through OAuth:
- You authorize us to access your account data and publish content on your behalf
- You acknowledge that we store OAuth access tokens and refresh tokens necessary for content publishing
- You agree that we do not store or have access to your social media account passwords
- You can revoke our access at any time through your social media platform's settings
6. User Responsibilities
You agree to comply with all applicable laws, regulations, and the terms of service of all connected social media platforms. You are solely responsible for:
- The content and materials you upload, schedule, or publish
- Ensuring all content complies with platform-specific community guidelines, including TikTok's Community Guidelines
- Obtaining all necessary rights, licenses, and permissions for content
- Ensuring scheduled posts do not violate intellectual property, defamation, privacy, or other rights
- Ensuring compliance with each platform's developer terms and API usage policies
- Compliance with the YouTube API Services Terms of Service (youtube.com/t/terms) and Google's Privacy Policy (policies.google.com/privacy) when using YouTube integration features
6A. TikTok-Specific Publishing Requirements
When publishing content to TikTok through the Service, you acknowledge and agree to the following TikTok API compliance requirements:
- Music Usage Confirmation: By posting content to TikTok via the Service, you agree to TikTok's Music Usage Confirmation. You represent that your content complies with TikTok's music licensing policies, and you accept full responsibility for any music included in your content.
- Explicit Upload Consent: Content is only transmitted to TikTok after you have expressly confirmed your intent to publish. Your explicit action to initiate a post constitutes consent to upload that content to TikTok.
- Commercial Content Disclosure: You are responsible for accurately completing TikTok's Content Disclosure settings when publishing branded, sponsored, or commercial content. Where required by TikTok's policies, you must disclose whether content promotes yourself, a brand, product, or service. Failure to disclose commercial content accurately may result in content removal or account penalties by TikTok.
- Editable Fields: All preset text fields, including titles and hashtags, are editable before publishing. You are responsible for reviewing and approving all content before submission to TikTok.
You may not use the Service to:
- Publish spam, harassment, hate speech, violent, or explicit content
- Violate any platform's community guidelines or terms of service
- Infringe on intellectual property rights
- Engage in artificial engagement manipulation or fraudulent activity
- Circumvent security measures or attempt to gain unauthorized access
- Reverse engineer, decompile, or attempt to extract source code
- Resell or redistribute the Service to third parties
8. Intellectual Property
The Service, including its design, functionality, content, and code, is owned by Publish Hub Pro or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or business use. You retain all rights to content you create and schedule.
9. Content Ownership & Publishing Rights
You retain all ownership rights to content you upload. By publishing through Publish Hub Pro, you grant us permission to transmit your content to the selected social media platforms via their APIs. Published content remains subject to the terms and policies of each social platform.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLISH HUB PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS.
11. Disclaimer of Warranties
The Service is provided "AS IS" without warranties of any kind. We do not warrant that:
- The Service will be error-free or uninterrupted
- Content will publish successfully or on schedule
- Social media platforms will not restrict or remove your account
- The Service is secure or free from malware
- Publishing will not be delayed or prevented due to third-party API quota limits, rate limits, or platform-imposed restrictions. Your use of the YouTube and TikTok integrations is subject to API quotas set by Google and TikTok respectively, which may limit publishing volume or frequency.
11A. YouTube Data & Revocation
If you connect a YouTube account, you grant us access to your YouTube channel data solely for the purposes described in this Service. You may revoke our access to your Google/YouTube account at any time via Google's Security Settings. Upon revocation, we will cease accessing your YouTube data. Google's use of information received from Google APIs is governed by the Google Privacy Policy.
12. Third-Party Services
The Service depends on third-party APIs and platforms (TikTok, Facebook, Instagram, etc.). We are not responsible for:
- Service interruptions or changes made by third-party platforms
- Account suspensions or policy violations on connected platforms
- Data loss on social media platforms
- Changes to third-party platform terms or functionality
13. Indemnification
You agree to indemnify, defend, and hold harmless Publish Hub Pro from any claims, damages, or costs arising from:
- Your use of the Service in violation of these Terms
- Content you publish that violates community guidelines or laws
- Your violation of any third-party rights
- Any illegal activity conducted through your account
14. Termination
We may suspend or terminate your account and access to the Service if you:
- Violate these Terms or applicable laws
- Publish content that violates community guidelines
- Engage in fraudulent or malicious activity
- Repeatedly violate social platform policies
Upon termination, your access to the Service and stored data will cease. We are not liable for any consequences of account termination.
15. Data Retention & Deletion
We retain your data and OAuth tokens as necessary to provide the Service. Upon account deletion, we will remove your data within 30 days, except where retention is required by law. You can request data deletion at any time by contacting our support.
16. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service or any feature at any time. We will provide notice of significant changes when feasible, but are not obligated to maintain any specific functionality.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the federal and state courts located in Delaware for any disputes arising from these Terms or the Service.
18. Dispute Resolution
For any disputes, you agree to attempt good-faith resolution by contacting us first at info@publishhub.pro. If unresolved within 30 days, either party may pursue legal action.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
20. Platform Compliance & Content Violations
We reserve the right to remove or refuse to publish any content that violates:
- TikTok Community Guidelines or other platform-specific policies
- Applicable laws and regulations
- Third-party intellectual property rights
- These Terms of Service
In cases of severe or repeated violations, we may suspend or terminate user access to the Service. Users remain solely liable for content published through the Service, and we are not responsible for removal, suspension, or penalties imposed by connected social platforms.
